Terms of Service for ZivaraJewels

These Terms and Conditions ("Terms") govern your use of the ZivaraJewel website: https://www.zivarajewels.co.uk/ and your purchase of any products from the Site. By placing an order, you agree to be bound by these Terms.

1. General Commercial Terms and Contract Formation

• Contracting Party: This Site is operated by Pranjali Upadhye trading as ZivaraJewels ("ZivaraJewels," "we," "us") with the principal business address at 28, Midhurst Avenue, Westcliff-On-Sea, SS0 0NR.

• The Offer: The display of products on the Site constitutes an invitation to treat, not a legally binding offer to sell.

• Order Acceptance: Your order is an offer to purchase the products. We accept your offer and form a binding contract only when we send you an email confirming the order has been accepted and shipped. We reserve the right to reject any order for any reason.

• Pricing and Errors: Prices are listed in GBP (Great British Pounds) and are subject to change without notice. In the event of a significant pricing error, we reserve the right to cancel the order and issue a full refund.

2. Product and Customization

• Product Representation: We make every effort to display the colors, materials, and dimensions of our jewelry and home décor as accurately as possible. However, due to monitor variations, we do not guarantee the display is 100% accurate. Natural variations in gemstones or handmade décor items are inherent and not considered defects.

• Hallmarking: Where required by the UK Hallmarking Act, products made of precious metals exceeding the legal weight threshold will bear a hallmark applied by a UK Assay Office.

• Personalized/Custom Orders: Orders for personalized, engraved, or custom-designed items are final once production begins and cannot be canceled or returned unless they arrive defective or damaged.

3. Payment, Shipping, and Delivery

• Payment: We accept payment through the methods listed on the Site (e.g., Wix Payments, PayPal). You confirm that the payment method used is yours or that you have authorization to use it.

• Shipping Costs: Shipping is calculated based on the weight, size and price of the items in your cart. Specific rates and thresholds for free shipping are detailed on our Shipping & Returns Policy page.

• Risk of Loss: Risk of loss and title for items purchased pass to you upon our delivery to the carrier. We are not responsible for packages that are marked as delivered by the carrier but subsequently go missing.

• International Shipments: The customer is solely responsible for any customs fees, import duties, or taxes levied by the destination country.

4. Returns, Refunds, and Statutory Rights

• Returns Policy: This section refers to our separate Shipping & Returns Policy page, which is incorporated by reference into these Terms. You have the right to return non-personalized items within 15 days of delivery, provided the items are unworn/unused, in original packaging, and with all tags/seals intact.

• For hygiene reasons, Earrings & Nose Pins cannot be returned if the hygiene seal has been tampered with or broken, unless the item is faulty.

• Statutory Rights: These Terms do not affect your statutory consumer rights regarding faulty or misdescribed goods under the UK Consumer Rights Act 2015.

5. Intellectual Property

• All content on the Site, including jewelry designs, décor designs, images, text, and logos, is the property of ZivaraJewels or its suppliers and is protected by copyright and intellectual property laws. You are not permitted to reproduce or use any Site content without our express written permission.

6. Limitation of Liability

• ZivaraJewels shall not be liable for any indirect, incidental, or consequential damages arising from the use of products purchased from the Site, except where such exclusion is prohibited by law. Our liability shall not exceed the total price of the product in question.

7. Governing Law

• These Terms are governed by the laws of England and Wales. Any dispute relating to these Terms will be subject to the exclusive jurisdiction of the courts in London, England.
